These Terms of Service (“Terms”) govern your use of the CryoStemCLT website (cryostemclt.com) and your participation in any SMS messaging programs operated by CryoStemCLT and Fyzical Mountain Island (“we,” “us,” or “our”). By accessing our website, submitting a form, or opting into our SMS program, you agree to be bound by these Terms. If you do not agree, please do not use our website or SMS services.
1. Description of SMS Use Cases
CryoStemCLT operates an SMS messaging program to communicate with prospective patients, current patients, and individuals who have expressed interest in our services. Our SMS communications fall into the following categories:
1.1 Appointment & Consultation Messages
- Booking confirmations for new consultations and follow-up appointments
- Appointment reminders sent 24 hours and 2 hours before scheduled visits
- Rescheduling notifications and cancellation confirmations
- Post-appointment follow-up and care instruction messages
1.2 Lead Follow-Up & Nurture Messages
- Initial response messages to individuals who have submitted a consultation request form
- Follow-up messages to leads who have not yet scheduled an appointment
- Re-engagement messages to individuals who previously expressed interest in our services
- Promotional messages regarding special offers, consultations, and new services (with consent)
1.3 Transactional & Operational Messages
- Payment confirmations and receipts
- Treatment plan communications and updates
- HSA/FSA payment processing confirmations
- Referral coordination messages
1.4 Health & Wellness Communications
- Educational content related to StemWave therapy, Cryo Body Sculpting, and other services
- Health tips, recovery guidance, and post-treatment care information
- Announcements of new services, promotions, or clinic news
| Consent Reminder All promotional SMS messages are sent only to individuals who have explicitly opted in to receive communications from CryoStemCLT. Transactional messages (appointment reminders, payment confirmations) may be sent to patients who have provided their phone number as part of receiving our services. |
2. How to Opt Out of SMS Messages
You have the right to opt out of our SMS messaging program at any time. We honor all opt-out requests promptly and without penalty.
2.1 Opt-Out Methods
- Reply STOP — Text the word STOP (or UNSUBSCRIBE, CANCEL, END, or QUIT) to any message you receive from us
- Text STOP directly to 704.900.2909
- Email us at info@cryostemclt.com with “SMS OPT OUT” in the subject line
- Call 704.900.2909 and ask to be removed from our SMS list
2.2 Confirmation of Opt-Out
Upon receipt of your opt-out request, you will receive one final SMS confirming that you have been successfully removed from our messaging list. No further promotional messages will be sent after this confirmation.
2.3 Re-Subscribing
If you wish to re-subscribe to our SMS program after opting out, you may do so by texting START to 704.900.2909 or by submitting a new opt-in form on our website.
2.4 Opt-Out Does Not Affect Other Communications
Opting out of SMS communications does not automatically unsubscribe you from email communications or cancel any existing service appointments. To opt out of email communications, use the unsubscribe link in any marketing email or contact us directly.

4. Message and Data Rates
| Standard Rates Apply Message and data rates may apply to all SMS messages sent to and from CryoStemCLT. These charges are assessed by your mobile carrier and are subject to your individual mobile plan. CryoStemCLT does not charge separately for SMS communications. |
4.1 Carrier Charges
Depending on your mobile plan, you may be charged per-message fees or the messages may be applied against a messaging allowance in your plan. Please contact your mobile carrier to understand what rates apply to your specific plan.
4.2 Message Frequency
Message frequency varies. You may receive between 1 and 10 messages per month depending on your level of engagement with our services. Promotional messages are sent no more than 4 times per month unless you have an active appointment or service in progress.
4.3 Wi-Fi and Data Usage
Receiving SMS messages may use your mobile data allowance if you are not connected to Wi-Fi. Standard data rates from your carrier may apply. CryoStemCLT is not responsible for any data charges incurred as a result of receiving our messages.
5. Carrier Liability Disclaimer
CryoStemCLT uses third-party SMS delivery infrastructure, including GoHighLevel and mobile carrier networks, to deliver text messages. We are not responsible for:
- Delayed, undelivered, or incorrectly delivered SMS messages due to mobile carrier network issues
- Service interruptions caused by carrier outages, technical failures, or network congestion
- Messages filtered or blocked by mobile carrier spam detection systems
- Charges assessed by your mobile carrier for receiving messages
- Any actions taken by mobile carriers related to our messaging program
Mobile carriers are not liable for delayed or undelivered messages. If you do not receive an expected message from us, please contact us directly at 704.900.2909 or info@cryostemclt.com.
5.1 Supported Carriers
Our SMS program supports all major US mobile carriers including, but not limited to: AT&T, Verizon, T-Mobile, Sprint, US Cellular, Boost Mobile, Cricket Wireless, MetroPCS, and Virgin Mobile. Coverage and delivery may vary by carrier and geographic region.
5.2 Short Code vs. Long Code
CryoStemCLT sends messages from a 10-digit long code (10DLC) number registered with The Campaign Registry (TCR) under the A2P 10DLC framework. This registration helps ensure message deliverability and compliance with carrier guidelines.
6. Age Restrictions

We do not knowingly market to, collect information from, or provide services to individuals under the age of 18 without verified parental or guardian consent. If you are under 18, please do not submit your information through our website or opt in to our SMS program.
If we become aware that a person under the age of 18 has submitted personal information or opted into our SMS program, we will delete that information and remove them from our messaging list immediately. To report such an instance, please contact info@cryostemclt.com.

8.2 Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Mecklenburg County, North Carolina.
8.3 Limitation of Liability
To the fullest extent permitted by applicable law, CryoStemCLT shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our SMS program or website.
8.4 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
8.5 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and CryoStemCLT regarding your use of our SMS program and website.
